Waiver And Release Of Liability Agreement

PARTICIPATION RELEASE

In consideration of my voluntary participation in activities, events, or programs organized by A+Media (collectively, “Activity”), I, the attended participant, hereby agree as follows:

ASSUMPTION OF RISK

I understand that participation in the Activity, including travel to and from related events, may involve inherent risks, including but not limited to physical or psychological injury, illness, paralysis, death, property damage, or economic or emotional loss. These risks may arise from my own actions, inactions, or negligence, as well as from the actions, inactions, or negligence of others, or the conditions of the facilities, equipment, or travel. I voluntarily assume all such risks, both known and unknown, and accept full responsibility for my participation in the Activity.

RELEASE AND DISCHARGE

I, on behalf of myself, my heirs, executors, administrators, assigns, and personal representatives, hereby release, waive, and forever discharge A+Media, its parent company, affiliates, directors, officers, employees, volunteers, clients, agents, attorneys, successors, and assigns (collectively, “A+Media”), from any and all claims, demands, causes of action, or liabilities of any kind, arising out of or in connection with my participation in the Activity. This includes but is not limited to claims for personal injury, property damage, economic or emotional loss, or wrongful death, regardless of whether caused by the negligence of A+Media or otherwise, to the fullest extent permitted by law.

INDEMNIFICATION AND HOLD HARMLESS

I agree to indemnify and hold harmless A+Media from and against any and all claims, suits, or actions brought by me or any third party on my behalf for damages, losses, or liabilities, including attorney's fees and costs, arising out of or related to my participation in the Activity.

MEDICAL RESPONSIBILITY

In the event that I require medical care or treatment during the Activity, I agree to be financially responsible for all associated costs. I understand that I am solely responsible for ensuring that I have adequate health insurance coverage to cover any such expenses.

DAMAGES TO PROPERTY OR EQUIPMENT

I agree to be responsible for any damage to property or equipment caused by my willful actions, negligence, or recklessness during the Activity. I further agree to reimburse A+Media for the full cost of such damages.

ACKNOWLEDGMENT OF ACTIVITY RISKS

I acknowledge that the Activity may test my physical and mental limits and carry risks caused by various factors, including but not limited to terrain, facilities, weather, hydration levels, equipment, vehicular traffic, and the actions of other participants, spectators, or event organizers.

NO MODIFICATION AND COMPLETE AGREEMENT

This agreement constitutes the entire understanding between the parties regarding the subject matter and supersedes all prior discussions or representations. No modifications to this agreement shall be valid unless made in writing and signed by both parties.

SEVERABILITY

If any provision of this agreement is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect. If a court determines that a provision is enforceable only if modified, such provision shall be deemed amended to the extent necessary to make it enforceable.

VOLUNTARY AGREEMENT

I affirm that I am of legal age (18 years or older) and that I have read and fully understand this Waiver and Release of Liability. I acknowledge that I agreed it freely and voluntarily, without duress or coercion, and with the understanding that it is a complete release of liability to the greatest extent permitted by law.

ACCEPTANCE OF TERMS

Attendance at the event constitutes your acknowledgment that you have read, understood, and agreed to this waiver of liability. If you do not agree to these terms, you should refrain from attending.

PARENT/GUARDIAN WAIVER FOR MINORS

If the participant is under the age of 18, this waiver must be agreed by a parent or legal guardian:

I, the parent or legal guardian of the minor participant, hereby consent to the terms set forth above on behalf of the minor. I affirm that I have read and understood this agreement and that I voluntarily agree to its terms. I understand that by attending this Activity, I am giving up substantial rights on behalf of the minor.
